RETREAT TERMS & CONDITIONS FOR SPOTTED DOG YOGA LLC (DBA SPOTTED DOG YOGA OR SPOTTED DOG YOGA & SUP)

By reserving or taking part in a retreat or any related services (collectively referred to as a “Retreat”) with Spotted Dog Yoga LLC, DBA Spotted Dog Yoga or Spotted Dog Yoga & SUP, (“Spotted Dog Yoga”), you acknowledge and agree to abide by the following Terms & Conditions (the “Terms”).

Confirming your reservation with a booking deposit means that you have read, understood, and accepted these Terms in full and have agreed to the Privacy Policy and Retreat Waiver of Liability.

1. Booking

Once your deposit is received, Spotted Dog Yoga will send a formal booking confirmation. Please review this confirmation thoroughly and notify Spotted Dog Yoga immediately if any information is incorrect or incomplete. Your name must match the details in your passport exactly.

Only individuals aged 18 or older may place a booking. By doing so, you confirm that all information you provide is complete and accurate.

2. Booking on Behalf of Others

If you are securing a reservation for multiple participants, you accept the role of primary point of contact for all individuals included in that booking. This means you are responsible for handling all payments, communicating changes or cancellations, and ensuring your group stays informed throughout the process.

3. Medical Information

Spotted Dog Yoga may require you to submit medical details, including completion of a Medical Form if necessary. You agree to provide this information honestly, disclosing all relevant health details. Any medical data you provide will be handled in accordance with Spotted Dog Yoga’s Privacy Policy.

For certain Retreats, a completed Medical Form is mandatory. Failure to submit the required medical information may result in cancellation of your reservation, subject to applicable cancellation fees.

If you have a pre-existing medical condition that could affect your ability to participate, travel to remote areas with limited healthcare access, or impact other guests’ experience, you must submit a completed Medical Form signed by a licensed physician before or upon final payment for your booking. Spotted Dog Yoga may request additional medical details or professional assessments at its discretion for safety reasons.

Spotted Dog Yoga reserves the right to decline participation or restrict involvement in specific aspects of the Retreat if your medical condition is deemed a risk to yourself or others.

Pregnancy must be disclosed upon booking. Spotted Dog Yoga may restrict participation for those beyond 24 weeks of pregnancy or individuals with certain medical conditions if necessary accommodations cannot be arranged.

You are solely responsible for determining whether a Retreat suits your health, fitness level, and individual needs. Consultation with a physician is recommended to assess readiness for travel and physical activities, including necessary vaccinations and medical precautions. Spotted Dog Yoga does not offer medical guidance or advice.

Certain Retreat locations may have limited medical resources or facilities that do not align with the standards of your home country. Spotted Dog Yoga does not guarantee the availability or quality of healthcare services at destination sites.

If you become incapacitated and cannot make medical decisions for yourself—without a designated individual on the Retreat to do so—and Spotted Dog Yoga is unable to reach your emergency contact, you authorize necessary medical care. This may include diagnostic procedures, hospitalization, surgical treatment, or any other medical intervention deemed appropriate by a licensed physician or qualified medical professional.

4. Age Requirements

Participants must be at least 18 years old at the start of the Retreat. Anyone younger than 18 is considered a minor and must be accompanied by a responsible adult. Each adult may oversee up to two minors unless otherwise specified in the Retreat details. The minimum age for minors attending a Retreat is 16 years old, unless indicated otherwise by Spotted Dog Yoga.

Bookings involving minors are subject to review and approval by Spotted Dog Yoga. If parental or guardian consent is legally required for a minor to travel, the accompanying adult must ensure all necessary documents and approvals are obtained. Spotted Dog Yoga is not responsible for any issues arising from missing documentation, legal requirements, or travel restrictions.

Adults booking a Retreat that includes minors accept full responsibility for their behavior, wellbeing, supervision, and compliance with these Terms. Each adult assumes liability on behalf of the minors in their booking, including risk acknowledgment and limitations of liability. Spotted Dog Yoga does not provide childcare services and is not responsible for overseeing minors during the Retreat.

5. Special Requirements

Any unique accommodations or needs must be communicated at the time of booking. While Spotted Dog Yoga strives to meet requests, availability may vary based on location and itinerary constraints.

Limited mobility may affect accessibility for certain activities, and Spotted Dog Yoga cannot guarantee modifications will be possible.

Food allergies and dietary restrictions must be disclosed during booking, though Spotted Dog Yoga cannot ensure all requests will be met. Spotted Dog Yoga holds no liability for any unmet accommodations or adjustments regarding special requirements.

6. Travel Insurance 

All participants are strongly recommended to have travel insurance that includes a minimum of $200,000 USD in medical, evacuation, and repatriation coverage for the duration of their Retreat. This insurance should cover personal injury and emergency medical expenses. Spotted Dog Yoga may request proof of insurance before participation.

It is your responsibility to inform your insurer about the nature of your travel, destinations, and activities to ensure proper coverage. Insurance costs are not included in the Retreat price and must be purchased separately. Spotted Dog Yoga is not liable for any medical, evacuation, or repatriation costs incurred.

Additionally, travel insurance can provide financial protection in case you need to cancel your trip unexpectedly due to illness, family emergencies, or other unforeseen circumstances. Depending on your policy, it may cover non-refundable costs such as flights, accommodations, and retreat fees, helping to minimize any financial loss.

7. Pricing, Surcharges, and Taxes

Retreat prices are listed inclusive of applicable taxes. 

8. Validity

All retreat itineraries and pricing are subject to change at any time. The most current pricing will be confirmed at the time of booking, including any applicable surcharges in accordance with these Terms.

9. Deposits

• To secure your spot, a non-refundable deposit of $1,000 is required at the time of booking.
• If booking 90 days or less before the retreat start date, full payment is required at the time of booking.

10. Information Required for Booking

To complete your reservation, you must provide all requested information. If you fail to submit the necessary details, Spotted Dog Yoga reserves the right to cancel your booking and apply applicable cancellation fees at its discretion.

The specific information required may vary depending on the Retreat and will be communicated during the booking process. Spotted Dog Yoga is not responsible for any fees incurred due to errors, omissions, or delays in providing accurate information.

11. Airfare & Ground Transportation

Transportation Disclaimer

Retreat pricing does not include airfare or ground transportation to and from the airport, unless explicitly stated in the retreat description.

Participants are responsible for securing their own transportation to and from the designated retreat location, including airport transfers. We recommend reviewing the airline’s terms and conditions for cancellation policies, baggage fees, and schedule changes, as Spotted Dog Yoga does not provide flight alerts or updates regarding air travel itineraries.

12. Final Payment & Acceptance of Booking

Spotted Dog Yoga will provide details regarding final payment deadlines. If full payment is not received by the due date, Spotted Dog Yoga may adjust the rate or cancel the booking, retaining the deposit as a cancellation fee.

For bookings made less than 90 days before the retreat start date, full payment is required at the time of booking.

Spotted Dog Yoga is not responsible for any third-party transaction fees incurred through credit card payments or financial institutions. These fees are non-refundable.

13. Cancellation by the Participant

If you need to cancel your booking, you must notify Spotted Dog Yoga in writing at [email protected]. Cancellation fees will be determined based on the date of cancellation:

• 91+ days before departure: Refund of payments made, minus the non-refundable $1,000 deposit. 
• Less than 90 days before departure: 100% of the total retreat price is forfeited.

14. Cancellation of a Retreat by Spotted Dog Yoga

Spotted Dog Yoga guarantees that all scheduled retreats with a valid deposit will proceed as planned, subject to reasonable itinerary changes or health and safety considerations.

In cases of Force Majeure, this guarantee does not apply, and refunds will not be issued. However, at its discretion, Spotted Dog Yoga may allow payments to be transferred to another retreat or held as a future credit.

For the latest retreat details, visit Spotted Dog Yoga’s website or contact us directly. Printed materials and brochures may be subject to updates and should not be relied upon for final itinerary details.

If Spotted Dog Yoga cancels a retreat for reasons other than Force Majeure, and the cancellation is not due to participant actions, you will have the option to:

(a) Transfer to a substitute retreat of equal or greater value.

(b) Transfer to a retreat of lesser value and receive a refund for the price difference.

(c) Receive a full refund of all payments made.

Spotted Dog Yoga reserves the right to issue a full refund in place of these options at its sole discretion.

15. Travel Documents

It is your responsibility to ensure you have all necessary documentation for travel, including a valid passport, visas, permits, medical certificates, and any other required identification. Your passport must be valid for at least six months beyond the final date of your retreat.

You are solely responsible for obtaining all required travel documents before the retreat begins. Any costs incurred due to missing or incorrect documentation are your responsibility. Spotted Dog Yoga is not liable for any expenses or losses resulting from failure to secure proper travel documents.

Spotted Dog Yoga does not provide guidance on visas, vaccinations, climate, clothing, baggage, or special equipment. Any information provided is for reference only, and Spotted Dog Yoga is not responsible for errors or omissions in such details.

16. Changes

Retreat itineraries may be adjusted before or during the retreat due to unforeseen circumstances, operational needs, or concerns for participant safety and comfort. You acknowledge that flexibility is essential for travel and agree to reasonable modifications made by Spotted Dog Yoga.

Schedules, accommodations, activities, and transportation may change without prior notice due to factors beyond Spotted Dog Yoga’s control, including but not limited to weather conditions, flight cancellations, political events, or entry restrictions. No refunds, discounts, or reimbursements will be issued for such changes.

You are responsible for ensuring you have sufficient financial resources to cover incidental expenses that may arise due to itinerary adjustments. Spotted Dog Yoga is not liable for unforeseen costs or disruptions.

Changes Made by You

You must ensure that all personal information provided to Spotted Dog Yoga is accurate. Any changes to your name or booking details are subject to approval and availability. Additional costs may apply, including administrative fees.

Cancellations are not considered changes and will be subject to the applicable cancellation policy. No modifications to bookings are permitted within 10 days of retreat departure.

17. Acceptance of Risk

Participation in a retreat may involve inherent risks to health and safety. By booking a retreat with Spotted Dog Yoga, you acknowledge and accept these risks. You assume full responsibility for any injuries, losses, or damages that may occur during travel or retreat activities.

Spotted Dog Yoga requires all participants to sign a participation waiver before attending the retreat.

The level of risk varies depending on the retreat location and activities involved. Some retreats may include physical activities or participation in outdoor excursions. Standards of hygiene, accommodations, and transportation may differ from those in your home country.

Spotted Dog Yoga does not provide guidance on local customs, weather conditions, safety concerns, or legal regulations in retreat locations. You are responsible for assessing your own capabilities and needs before participating.

Compliance with Laws

You must comply with all local laws and regulations during the retreat. If your behavior is deemed disruptive, unsafe, or illegal, Spotted Dog Yoga reserves the right to terminate your participation without refund. You will be responsible for any costs incurred due to termination, including return travel and accommodations.

Responsibility for Damages

You are responsible for any damage, loss, or theft caused by you during the retreat. Any costs incurred for repairs, replacements, or cleaning will be charged to you.

Safety Measures

You agree to follow all safety instructions, including the use of seatbelts, flotation devices, helmets, and other protective equipment. Spotted Dog Yoga and its partners are not liable for injuries or damages resulting from failure to comply with safety guidelines.

18. Not Liable for Third-Party Providers

Spotted Dog Yoga partners with various service providers, including accommodation hosts, transportation operators, activity facilitators, and local guides (“Third-Party Providers”) to enhance your Retreat experience. While we carefully select these Third-Party Providers, Spotted Dog Yoga does not control or supervise them and, therefore, cannot be held responsible for their actions or omissions. Any services provided by Third-Party Providers are subject to their respective terms and conditions.

You acknowledge that Third-Party Providers operate in accordance with local laws, and Spotted Dog Yoga does not guarantee compliance with regulations beyond their jurisdiction.

Spotted Dog Yoga is not liable for any inconveniences, disappointments, emotional distress, or losses arising from the actions or omissions of anyone other than Spotted Dog Yoga and its employees. Furthermore, Spotted Dog Yoga is not responsible for any negligent or intentional acts of Third-Party Providers or independent contractors.

19. Additional Activities

“Additional Activities” include any transportation, excursions, meals, wellness services, or other offerings not explicitly included in the Retreat package. If you choose to participate in Additional Activities, you do so at your own discretion. Any assistance provided by Spotted Dog Yoga representatives in arranging these activities does not imply liability or endorsement.

Spotted Dog Yoga disclaims all responsibility for any outcomes related to Additional Activities, including injury, illness, property damage, or emotional distress. Any associated liability remains solely with the third-party provider delivering the service or activity.

20. Liability

Spotted Dog Yoga, its affiliates, employees, and representatives are not responsible for:

(a) Any loss, damage, or injury resulting from the actions or failures of other service providers, including issues related to transportation, accommodations, or activities.

(b) Delays, disruptions, or cancellations caused by external forces, including legal regulations, government orders, natural disasters, strikes, pandemics, or other unforeseeable events beyond Spotted Dog Yoga’s control.

You waive any claims against Spotted Dog Yoga for any damages or losses resulting from these circumstances.

For non-personal injury claims, liability will be limited to the amount paid for the Retreat, excluding insurance or administrative fees. Liability for lost or damaged personal items will not exceed $1,000 USD, and Spotted Dog Yoga is not responsible for valuables.

21. Force Majeure

Spotted Dog Yoga is not liable for any death, injury, illness, property damage, delay, or financial loss—whether direct or indirect—resulting from circumstances beyond its control. Such circumstances may include, but are not limited to, natural disasters, fires, floods, acts of war or terrorism, civil unrest, labor disruptions, governmental regulations, health advisories, pandemics, epidemics, quarantines, or any other event that prevents, discourages, or makes it impractical to conduct the Retreat.

If any Force Majeure event occurs, Spotted Dog Yoga reserves the right to cancel, reschedule, or modify the Retreat without liability for compensation or damages. You acknowledge that participating in the Retreat amidst such conditions is at your own discretion, and Spotted Dog Yoga is not responsible for any resulting inconvenience or loss.

22. Images and Marketing

During your participation in a Spotted Dog Yoga Retreat, you may appear in photographs, videos, or other media captured by fellow participants or Spotted Dog Yoga representatives. By attending, you grant Spotted Dog Yoga a perpetual, worldwide, royalty-free license to use, reproduce, and distribute such images for marketing, promotional, and branding purposes, in any format or medium—whether currently existing or developed in the future—without further obligation or compensation to you.

If you prefer not to be included in promotional materials, please notify Spotted Dog Yoga in writing before the retreat begins at [email protected].

23. Severability

If any provision of these Terms is found to be legally unenforceable, that provision will be interpreted in a way that remains valid to the fullest extent permitted by law. The invalidity of a single term does not impact the enforceability of any remaining provisions.

24. Contract Parties and Successors

These Terms are binding upon and will benefit the respective heirs, legal representatives, successors, and permitted assigns of both parties.

25. Applicable Law

These Terms and your participation in a Spotted Dog Yoga Retreat are governed by the laws of the State of California. Any disputes arising from these Terms will be resolved in the courts located within Sacramento, California, which shall have exclusive jurisdiction over such matters.

26. Amendments

Spotted Dog Yoga reserves the right to update or modify these Terms and Conditions at any time. Any amendments will be published on Spotted Dog Yoga’s website and will take effect 10 days after posting. The most current version of these Terms will always be accessible on our website, and by continuing with your retreat registration after that period, you are considered to have accepted the changes.

We recommend reviewing these Terms before your retreat to ensure you are aware of the most up-to-date policies.

27. Privacy Policy

Spotted Dog Yoga collects and processes personal information necessary for organizing and delivering your retreat experience. We limit the use of your information to what is reasonably required for coordinating services with third-party providers, as outlined in Spotted Dog Yoga’s Privacy Policy (below).

RETREAT WAIVER OF LIABILITY FOR SPOTTED DOG YOGA LLC (DBA SPOTTED DOG YOGA OR SPOTTED DOG YOGA & SUP)

Participant Waiver:

This Participant Waiver (“Waiver”) applies to my participation in a Spotted Dog Yoga Retreat and my relationship with Spotted Dog Yoga, including its affiliates, employees, instructors, guides, volunteers, independent contractors, representatives, insurers, successors, and assigns (collectively referred to as the “Releasees”).

For the purposes of this Waiver, the term “Retreat Activities” includes all activities, events, and services provided, arranged, or facilitated by Spotted Dog Yoga, including but not limited to yoga, meditation, wellness practices, and adventure-based activities.

Acknowledgment of Risks

• I acknowledge that participation in Retreat Activities involves inherent risks, including but not limited to:
• Physical exertion that may activate or aggravate pre-existing conditions.
• Unpredictable environmental factors such as weather changes or uneven terrain.
• Encounters with wildlife or natural elements.
• Equipment malfunctions or improper use.
• Travel-related risks, including delays or unforeseen disruptions.

I understand that Spotted Dog Yoga does not provide medical insurance and that I am responsible for securing my own travel and health coverage.

Assumption of Risks

I voluntarily assume all risks associated with Retreat Activities, including the possibility of injury, illness, emotional distress, property damage, or financial loss. I acknowledge that these risks exist even with proper instruction and safety precautions.

If I choose to consume alcohol or any substances before or during the retreat, I accept full responsibility for any consequences and agree to indemnify the Releasees against any claims arising from such consumption.

Release of Liability & Indemnification

In consideration of being allowed to participate in Spotted Dog Yoga Retreats, I agree to:

1. Waive any claims against Spotted Dog Yoga and the Releasees for injuries, damages, or losses arising from my participation, except in cases of gross negligence or reckless misconduct.

2. Hold harmless and indemnify Spotted Dog Yoga and the Releasees from any liability for damage to property or injury to third parties resulting from my actions.

3. Acknowledge that this Waiver is binding upon my heirs, legal representatives, and assigns.

4. Agree that any disputes will be governed by the laws of California and resolved in the courts of Sacramento County, California.

Acknowledgment & Agreement

I confirm that I have read and understood this Waiver before signing it. I acknowledge that by signing, I am waiving certain legal rights that I or my heirs may have against Spotted Dog Yoga and the Releasees.

For participants under 18 years of age, a parent or legal guardian must sign this Waiver on their behalf.
